We use personal information to arrange transactions on your behalf as agreed with you, to service our clients, assist with claims and the payment of plan benefits. We must have a lawful basis to collect and use personal information.
Needed For Your Contract
We need to collect and use your personal information to provide your plan contract. This includes, but is not limited to, your name, date of birth, contact and bank account details. Depending on the plan type this can include health, employment, pension and salary information. We restrict access to, and use of, any sensitive personal information.
Personal information needed for plan contracts is held and used to: process your application; set up and issue your plan; provide you with information about your plan; help with plan administration and benefit payments; provide customer care and service; and contact you about any relevant actions you may need to take.
Required By Law
We use your personal information to comply with law and regulations, including reporting to regulators, keeping proper books and records, and meeting our Anti-Money Laundering obligations. This includes collecting proof of identity and address, screening against Financial Sanctions and Politically Exposed Persons lists, and collecting your tax residence information and tax identification number.
Legitimate Interest
We use your personal information for our legitimate business interests, including combining and grouping anonymised information for statistical analysis to help us understand our clients and develop better services. We believe these uses benefit our customers and do not affect your privacy rights.
Your Consent
Where we rely on your consent — for example, to send you direct marketing communications — we will explain this clearly at the time and give you the choice. You can withdraw your consent at any time by contacting us directly or using the opt-out link in any marketing emails we send you. Withdrawing consent does not affect the lawfulness of any processing before the withdrawal.
How and Where Do We Get Your Personal Information
You provide us with your personal information directly when you contact us, complete our forms, speak with us or visit our social media accounts. We also get personal information from solicitors, employers or regulators where relevant. We also create new personal information about you based on information you have given us and through your interactions with us.
To Whom Do We Pass Your Personal Information
We pass personal information to:
- Data Processors: insurance companies and investment providers with whom we hold written appointments, and IT service providers we use to support our business operations. All act under contract with us and only process your personal information as instructed by us. Your information is transferred securely and is not used for any other purpose.
- Trustees: trustees appointed in connection with your plan contract, where applicable.
- Investment Service Providers: where you wish to access investment services through your plan, we may pass limited personal information to the relevant provider such as a stockbroker or online trading platform.
- Regulators: the Revenue Commissioners and other regulatory bodies, as needed to comply with regulations and laws.
Artificial Intelligence and Technology
McNamara Wealth uses artificial intelligence (AI) tools to support certain administrative and communication functions within the firm. AI is used solely as a writing and administrative support tool. No personal data, client information, or sensitive details are entered into any AI system at any time. All AI-assisted work is reviewed by a qualified professional before use. Your personal data is not processed by any AI system.
Do We Transfer Your Personal Information Outside of the EU?
Your personal information is processed and stored within the EU.
How Long Do We Keep Your Personal Information For?
We keep and use your personal information for as long as you have a relationship with us. We also hold it after this where we need to for complaints handling, for system back-ups and for as long as we are required to under regulations. We will let you know how long we keep personal information for when you use a specific service such as a quote or call-back.
What Are Your Rights?
You have a number of rights over your personal information which you can exercise free of charge by contacting us. We will respond within one month.
- Right to Information: to be informed about how we collect and use your personal data, and to be notified of any material changes.
- Right to Restrict or Object: to restrict or object to any unfair or unlawful use of your personal information, including direct marketing.
- Right to Correct and Update: to ask us to correct or update any inaccurate personal information we hold about you.
- Right to Delete and Be Forgotten: to have your personal information deleted where it is no longer needed or has been processed unlawfully. Note that where we have provided a regulated product or service, we must retain certain records for a minimum period by law.
- Right to Portability: to receive a copy of your personal information in a machine-readable format, or to have it transferred to another organisation.
- Right to Access: to know what personal information we hold about you and to receive a copy.
